Please thoroughly review the following Terms and Conditions of KristieLen Travel, LLC, here forward referred to as KLT. The lead booking passenger, by receiving these terms and making payment to the supplier through KLT, acknowledges, reviews, and accepts these terms and conditions and contract for travel-related services and bears the responsibility of sharing these terms with all travelers.

COVID/Other current medical outbreaks affecting travel:  Travelers should be aware of current Covid /Other entrance requirements/restrictions before engaging in a booking to a foreign country. Changes in requirements can change at any time and it is the traveler’s responsibility to monitor for changes and meet entrance requirements and/Or testing timelines prior to departure.

QUOTES - Quotes are delivered at the current supplier price and with current availability, both of which are subject to change at any time until a trip is paid in full. No space is held with a quote. A quote will show what is included in the pricing. QUOTED RATES DO NOT INCLUDE: Airline baggage charges, seat assignment fees or other ancillary fees, passport and visa fees, some departure taxes, gratuities, meals, beverages, resort fees, hotel energy surcharges, parking and valet fees, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature that are not included in our quoted fees, except where specifically noted.

KLT is not responsible for any errors or omissions in any quotes, or advertisements, including on our website, resulting in inventory, content, or pricing discrepancies, nor is KLT responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold KLT harmless for any actions or damages arising from supplier pricing.

FEES - KLT does not charge for regular travel quotes. KLT does not charge additional fees for all-inclusive packages, travel packages, cruises, or supplier tour/packages. After two quotes are presented, an agent may request a $150 “Plan to Go” deposit, to be applied toward their future chosen trip price. It is not an extra charge, but rather a display of intent to travel. If the client decides not to travel, the PTG deposit will be retained by the agency. In addition, customized trips or tours may incur a customization planning fee of $150-$350 depending on how time-laden the planning will be. An Agent will discuss this and present it in writing for your approval should this become necessary. Agency Cancellation fees are $50 per person.  Agency Late payment fees are $25.  Agency Reservation change fees post-booking is $25 per change. These fees are in addition to supplier fees and merely supplement the time it takes agents to contact suppliers to instigate a cancellation or change. At times, agents are on hold for several hours to reach the supplier’s agent lines to make direct changes/cancellations. These changes also apply to contracted groups. Air-only fees are $50 per person-domestic round trip, and $100 per person International round trip. Additional legs incur a $25 fee. Supplier fees may be added. There is no fee for air bookings as part of a commissionable package booked with one supplier. (Air + hotel, car, transfer, etc.) The fees cover non-commissionable air bookings. Some bookings are commissioned-protected and if a refundable booking is canceled, commissions may be deducted by the supplier. Any “plan to go” deposits or fees are payable directly to KLT through the host, Outside Agents.

TRAVEL DOCUMENTS - All passenger(s) assume sole responsibility to confirm all documentation requirements for all passport, visa, vaccination, or other entry and/or travel requirements of each destination. Passenger(s) assumes sole responsibility for and hereby releases KLT from any claims or responsibility for any and all damages incurred as a result of Passenger(s) failure to comply with applicable documentation requirements, including but not limited to the requirement that all passengers carry the proper travel documents with them at all times. KLT recommends the passenger(s) consult with the appropriate domestic and foreign governmental agencies for the current document requirements. Everyone, including children and infants, MUST have a VALID passport to travel internationally (not a Passport Card). Failure to comply will result in denial of boarding, with no refund; there are no exceptions (out of the USA). KristieLen Travel, LLC is NOT responsible for passports in ANY way. Passports are required to be valid for 6 months from your return date. PASSPORT CARDS ARE NOT VALID FOR TRAVEL INTERNATIONALLY VIA AIR!  Some countries, such as Canada, have strict rules regarding entry to the country for prior criminal offenses, including DUI. KLT assumes no responsibility for entry denial in such instances. The obtaining of a passport may also be denied if the person applying is in arrears with child support.

It is your responsibility to ensure the accuracy of all information on a quote/booking prior to payment.  You will receive a fresh copy of your reservation documents after payment. Again, double and triple-check everything.  You should check all name spellings, dates of birth, destination, lodging, transfer, dates, insurance, etc. Any missed corrections will need to be corrected immediately. If not corrected in a timely manner, errors can result in increased costs or lost payments and will be your responsibility.

Keep in mind, air tickets are electronic. You will receive receipts of purchases and flight schedules.  Often, as soon as there is money on a booking you can use the record locator (six letters) to go in and view/select/change seats. 24 hours prior to departure, you can check in with most airlines and, in many cases, print your boarding passes or have them sent to a mobile device. You can also print them at the airport kiosk or counter. Please ask KLT if you have questions. Be sure to have your ID/Passport and a major credit card for any baggage fees.

PAYMENTS - KLT pays the suppliers directly and most accept Visa, American Express, Discover, and Mastercard. Cash is never accepted.  If a booking is placed on hold, KLT will hold the reservations until the “Deposit Due Date” indicated on your confirmation. Some want the deposit before the said date, and some want it ON or by the said date. KLT prefers deposits to be made 48 hours prior to the said date to automatically avoid cancellation. Failure to communicate to KLT to remit payments on a timely basis will automatically put your booking at risk of cancellation. Many people enjoy being able to deposit and pay off a trip over time. You may contact KLT in advance, and in writing, to schedule a payment, or request payment through the portal. Payments may be made at any time you are paying out a trip. Generally, KLT makes payments to suppliers once a week. Payments must be at least $200 per payment unless the final due is less.  Any payments due on a Saturday or Sunday will automatically revert to being due on Friday, 6:00 PM EST, which means payments should be made by Wednesday.  These measures are in place to protect you, the passenger, from cancellation due to forgetting, trying to pay when the office is closed, not submitting new card numbers to KLT, spending over the daily limit, etc. KristieLen Travel, LLC is not responsible for cancellations or cost variations of reinstatement due to payments made after the due date. Final payments are considered due by KLT 4 days prior to the supplier’s final date. KLT utilizes the 4-day window time frame up until the final hour to make payments. It is the client’s responsibility to make sure finances are in place so that payment will be successful, and KLT is in no way responsible for bookings that cancel due to non-approved payment as long as attempted by the supplier deadline.

LATE FEES - Final payments not received prior to the due date (4 days prior to the official written date) above will incur a $25 per person late fee. All reservations are subject to cancellation by the supplier if not received on time. Late fees are not covered by travel insurance and are always non-refundable.

Passenger(s) hold KLT harmless for cancellation of any booking for either late payment or declination of a credit card. Passengers are liable for all charges or chargebacks placed on credit cards. The client agrees to not file any chargebacks on KLT.  KLT maintains high security with all personal information. KLT is not responsible for any losses or damages associated with the fraudulent use of credit cards and the client shall hold KLT harmless from any and all losses, damages, or claims of any kind arising from or connected to the fraudulent use of credit card, or supplier delay in refunds.

CHANGES TO RESERVATIONS - ANY changes or cancellations made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. Change fees may apply.

FINAL PAYMENT - In most cases, the final payment MUST be received NO LATER THAN 45 days prior to departure. If booked within less than 45 days, full payment will be due upon booking. KLT establishes final payment as 4 business days prior to the actual final payment to allow time for correction for credit card issues, daily limits, etc. KLT will make the final payment by the indicated date from the supplier. Generally, courtesy reminders that this will occur are communicated to the client, but at times, if it is not possible to reach the client by the payment deadline, KLT reserves the right to automatically charge the final payment. KLT is NOT liable if final payment attempts are not successful as the client is responsible for having the payment approval ready with their credit card company. The client is responsible to supply KLT with any new card to be used, CVV, address, or expiration date changes. Card changes, splitting payments, or any new changes to payments from the original card must be communicated from the client to KLT well in advance of the four-day KLT final payment window. Please note on your calendar this final payment date and plan to have it paid by KLT a few days in advance. Cancellation, revision, and refund policies for changes or unused travel/components vary and are subject to the policies of each supplier. Cancellation penalties can range up to 100% depending on how close to departure the written notification is received.

If the number of individuals occupying the room changes, the remaining travelers will be responsible for any additional costs incurred because of the change in the per-person occupancy rate.  Air, insurance premiums, and no-shows are generally non-refundable. KLT reserves the right to charge a $50 per person administrative fee payable before cancellation will be processed. All cancellation or change requests must be made in writing. Agency change fees post-booking are $25 per change and late payment fees are $25.

AIRFARE - Air-only passengers must be prior clients or if not, must be local and be able to present and prove identity in person. This is not applicable to contracted groups. Airline tickets are highly restrictive, non-refundable, and non-transferable. Any changes in passenger names, dates, times, routings, or departure/arrival airports are at the sole discretion of the airline and, if permitted, will likely be subject to a substantial change fee.  The passenger is responsible for any such fees.  Regarding the purchase of air tickets, KLT acts simply as an intermediary between the passenger and the airline.  Once you book a reservation, your credit card or debit card will be charged for the amount shown – regardless of whether the reservation is used. Credit will not be given for any unused airline tickets and cannot be used toward any future bookings unless covered under travel protection.  Exceptions were made for a while with Covid. All tickets will be issued for economy class unless otherwise requested, and usually at bulk rate unless otherwise specified or published rate is requested.  All travel will be round-trip unless otherwise specified.  Seat assignments are subject to the airline's policies and may not be able to be made until you are at the airport on the day of departure.  Airline tickets booked through KLT may not be eligible to earn frequent flyer miles or be upgraded (Bulk). If you wish to upgrade, etc, you must inform KLT prior to booking.  You agree to confirm all bookings with the airline prior to the stated date of departure. Direct flights may be “non-stop” or may involve one or more stopovers (in the latter case this means the same flight by the airline because the flight number remains the same.)  The same applies to connecting flights that may be subject to crew changes.  When you reserve a scheduled or charter flight involving a stop-over in a city, and the second flight takes off from a different airport to the airport of arrival, ensure that you have sufficient time for reaching the second airport.  The journey to the other airport is at your own expense.  KLT will not be able to reimburse you for these costs, nor will it be liable if you miss the second flight. KLT’s responsibilities with respect to air travel are limited by the relevant airline’s conditions of carriage.  The airline fulfilling your contract for carriage may change from the airline mentioned by KLT.  KLT is not able to specify the type of aircraft to be used by any airline.  If an airline cancels or delays a flight, you must work directly with the airline to ensure you arrive at your destination on or ahead of time.  KLT will not provide any refund for trips missed, in part or full. Packaged trips often save money as the airlines have negotiated undisclosed contracted or bulk rate pricing with suppliers. Please be aware that often the air bears strict restrictions, including the inability to upgrade, make changes, or even allow advanced seat selections. Occasionally airlines change flight schedules & may even cancel flights entirely. These changes are beyond KLT’s control. If such a situation occurs; KLT will do its best to assist you with finding the best possible alternative option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). KristieLen Travel, LLC will notify you of major changes received.

Please Note: There may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. KristieLen Travel, LLC is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last-minute airline flight time changes within 24 hours of departure. KristieLen Travel, LLC is not responsible for changes that may occur within 24 hours of the original flight departure time and any assistance or changes within 24 hours must be handled directly with the airline. Reconfirm your flights 24-72 hours in advance.  Air tickets must be used in the way they are booked. It is recommended that travelers protect air and all other aspects of the trip with travel insurance.

LIMITATION OF LIABILITY FOR AIR-IN ADDITION TO THE LIMITATIONS OF LIABILITY SET FORTH ABOVE, YOU AGREE THAT KLT IS NOT LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO ANY AIRLINE TIMETABLE CHANGES, DELAYS, CANCELLATIONS, MISSED CONNECTIONS, MECHANICAL PROBLEMS, INCLEMENT WEATHER, SEATING/CLASS REASSIGNMENTS, LOST/DELAYED BAGGAGE, SCREENING AND SECURITY DELAYS, REFUSED BOARDING OR FAILURE TO CHECK-IN PROPERLY.

Federal law forbids the carriage of certain hazardous materials, such as aerosols, fireworks, and flammable liquids, aboard the aircraft. If you do not understand these restrictions, contact your airline, or go to http://www.faa.gov/about/initiatives/hazmat_safety.

BAGGAGE – Each airline has its own policy regarding baggage. KLT recommends that you check with your airline ahead of time for any weight restrictions and additional charges relating to checked or carry-on baggage. Due to continual changes in airline baggage policies, it is suggested that you inquire with your airline’s website for up-to-date fees and information. KristieLen Travel is NOT responsible for additional fees incurred for baggage or seating.  BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE! Please review ‘Updated Checked Bag and Carry-On Bag Rules” at www.TSA.gov. The airline is liable to you for the baggage you entrust to it only for the compensation contemplated in the international conventions and relevant statutes. In the event of damage, late arrival of bags, theft, or loss of luggage, you should contact your airline and declare the damage, absence, or loss of your personal effects before leaving the airport. Then submit a declaration, attaching the originals of the following documents: 1) the travel ticket; 2) the baggage check-in slip, and 3) the declaration.  KLT strongly recommends that you obtain an insurance policy covering the value of your items.

ACCOMMODATIONS - “Accommodations” are defined as lodgings in a dwelling or similar living quarters afforded to travelers including, but not limited to, hotels, condos, quarters in cruise ships, motels, timeshares, campgrounds, and resorts. KLT can make recommendations but makes no guarantee about the suitability or availability of accommodations, and if the accommodations sought are unavailable, we will do our best to reserve comparable accommodations, if possible.  The passenger would bear any additional costs, i.e. upgrades, etc.  KLT reserves the right, for technical reasons, in cases of force majeure or actions by third parties, to replace the planned hotel with accommodation of the same category offering equivalent services.  This would only be in exceptional circumstances and in such cases, KLT will inform you as soon as it is aware of this necessity. Policies regarding taking possession of and vacating rooms often vary by hotel and/or country, so it is your responsibility to check with the hotel ahead of time to verify the relevant policies and times.  KLT is not responsible for any charges and damages resulting from your failure to timely take possession or vacate your room.

Room classifications and amenities may vary by hotel and/or country, so it is your responsibility to check with the hotel ahead of time to verify the specific amenities offered at the time of your stay.  KLT agents visit many resorts, hotels, etc. so that they can properly match up clients with a great property, and great value. At times, mechanical issues, or other unplanned issues arise. If you have any issues, always approach the hotel staff nicely and allow them the opportunity to remedy the situation. If you continue to have issues, please contact KLT. KLT makes no guarantee that its descriptions and photographs are an exact representation of the rooms offered. Please discuss room options before selecting.

MEAL PLANS - Meal Plans may be All-inclusive, including food and drinks. Full board includes room and meals, but no drinks. Half board includes room and breakfast and choice of lunch or dinner, but no drinks. European indicates no meals or drinks.

ACTIVITIES/EXCURSIONS - All activities/excursions may not be appropriate for all ages or for individuals with certain medical conditions. KLT may not be held liable in the event of an incident or accident which is due to a lack of vigilance on your part. It is possible that certain planned activities/excursions referred to in the trip description are no longer provided by our local provider for climatic reasons, in the event of force majeure, during a stay out of the tourist season, or when the minimum number of participants required for providing a given activity is not reached (examples:  group sports, children’s clubs.)  In the early or late season, some activities may not be available, some of the facilities (restaurant, swimming pool, etc.) may be closed, or maintenance work may be in progress.  As a rule, entertainment and sports activities may vary in frequency depending on how many people are staying at the time and on climatic conditions.  Particularly during the high season, it is possible that the number of cabanas, loungers, sports equipment, etc., is insufficient for the demand.  The opening hours of bars, restaurants, clubs, etc., may be irregular and dependent on the management of the establishment in question.  KLT is not liable for activities/excursions unavailable due to any of the reasons listed above. Excursions are often organized by Destination Management Companies.  KLT can arrange excursions in advance. Any costs related to such activities are at the customer’s expense.  Similarly, these activities may be withdrawn at the discretion of the organizer if there is insufficient demand or poor weather conditions. KLT is not responsible for such occurrences. The use or enjoyment of an activity may be hazardous and inherently risky, and to the maximum extent permitted by law, KLT shall have no liability for any personal injury or death; lost, stolen, or damaged/destroyed property; or by other liability arising out of or in connection with the use and operation of activity or excursion and all actions or events before, during, or after the activity.

TRAVELING WITH CHILDREN - Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Please ask KLT for forms if needed. KristieLen Travel, LLC is not responsible for the lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.

Infants - KLT asks parents traveling with infants to bring appropriate food for their child, as specific foods may not be available at their destination.  You may be asked to pay a charge, for example for the provision of a cot and/or for heating baby food and drinks. You should request this when making your reservation, though we cannot confirm the availability of such services. Many resorts are very baby/toddler friendly and can provide cribs, changing tables, etc. Please make KLT aware if you will need appropriate accommodation.

Pregnant women - KLT advises pregnant women to consult their doctors before making any reservation, to confirm that it is appropriate for them to participate in the trip. KLT will not be liable for any damages arising from the inability to participate in any or all of the trip due to pregnancy or related illness, and no compensation will be payable under such circumstances.

TRAVELERS WITH SPECIAL NEEDS/DISABILITIES - If you have special needs or a disability and need specific accommodations you must inform KLT prior to booking.  KLT can inquire regarding accommodations but makes no guarantee as to the availability of any accommodations, activity provider, or facilities advertised on its site to meet the special needs of disabled clients.  For information concerning the suitability of disabled persons for any portion of any travel or other reservation, it is recommended that you contact the hotel directly.

CANCELLATION POLICIES - All cancellations or no-shows are subject to penalties imposed by the supplier. If you require a copy of these terms, please ask your agent at KLT. Additionally, all booking cancellations, transfers to another Agency, or no-shows are considered cancellations and subject to a non-refundable $50 per person fee imposed by KLT. The cancellation fees imposed by KLT are waived if the written request is received within a 3-business day grace period from your booking date. All cancellations MUST be in writing and sent to KLT by e-mail to the agent who made the booking, PLUS a copy emailed to Kristie@Kristielentravel.com.  Cancellations sent to any other address will not be processed.

Upon making the booking, Passenger(s) hereby accept & acknowledge liability for all cancellation fees imposed by KLT and the supplier. Cancellations are processed on the day of request if the request is received by KLT by 12:00 PM Central Standard Time of a business day (M-F.)  All other cancellations will be posted on the next business day. The client’s cancellation will be confirmed via email from KLT once processed. Please note, if the processing of cancellation falls during the supplier’s time of imposed fees, the client will be liable for those fees. * This includes forced cancellations of one reservation to create a last-minute change in destination, occupancy, transfers, etc. regardless of the reason.

TRAVEL PROTECTION - Though optional, travel insurance protection is strongly recommended. As your travel agent, KLT has a professional responsibility to recommend the purchase of travel protection to protect both you and your vacation investment. While KLT does offer coverage through certain carriers or suppliers, KLT cannot compare all the policies or companies currently in the marketplace. This responsibility rests solely with you the customer, and KLT advises you to do your research and find coverage that best fits your individual needs. KLT is limited in advising you of the need for such coverage. By declining travel protection, you acknowledge that you prefer to take the risk of and accept liability for any cancellation penalties, damages, and/or out-of-pocket expenses incurred.  You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you will be required to document your denial in writing.  Failure to reply to written requests of denial confirmation will be considered a waiver of travel protection. Please note that Covid, Zika, etc are not covered by standard insurance policies, and a CFAR (Cancel For Any Reason) policy/rider is recommended. While many companies initially included Covid-related illness, and some still do, KLT suggests clients phone insurance companies for a complete summary of coverage and to ask any questions.

All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you, the passenger, are responsible for reviewing upon receipt of your travel protection policy. KLT is not able to give advice about possible cancellations and any associated claims processing. All queries regarding cancellation, penalties, and coverage should be directed to your travel insurance provider.  Please note that the travel insurance provider may not be allowed to discuss your claim with KLT due to privacy laws (e.g. HIPAA.)  Accordingly, you acknowledge that KLT cannot be involved in any aspect of your claim/request for service. Passenger(s) acknowledge and agree that KLT has no control over the travel insurance provider or its coverage decisions, and as a result, KLT is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims. AGENT/INTERMEDIARY - KLT merely serves as an intermediary between the Suppliers and the public. KLT does not own or operate any hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines, travel protection companies, attractions, or other travel-related Suppliers who provide goods or services for the Passenger(s)’ trip.  Passenger(s) acknowledge and agree that KLT shall not be responsible for any loss, damage, delay, inconvenience, or injury to Passenger(s) or group members as a result of a breach of contract, act, or omission whether willful or negligent, criminal or otherwise of any person other than KLT or its direct employees. While KLT prides itself on selecting top quality Suppliers, no undertaking, guarantee, or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied.  Passenger(s) acknowledge and agree that KLT shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier.  In no event shall KLT be liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, on board a cruise ship, on tenders, onshore excursions, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation, and handling of passengers and baggage.

LIMITATION OF LIABILITY - Without limitation, Passenger(s) assume the risk of, and agree that KLT is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, pandemics, epidemics, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, price drops post booking, physical harm by others,  food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage. KLT has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.  KLT has no control over and is not responsible for any weather conditions.

MODIFICATION OF TERMS AND CONDITIONS – These Terms and Conditions may be amended or modified by KLT at any time without notice.  It is therefore essential that you consult the Terms and Conditions prior to making each and every booking, particularly in order to ensure what provisions are in operation in case they have changed since the last time you booked.  Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with KLT.  Without this acceptance, any order is subject to cancellation at any time. The failure of KLT to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. KLT does not guarantee it will act against all breaches of these Terms and Conditions.

SEVERABILITY - If any provision of this agreement shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

ALTERNATIVE DISPUTE RESOLUTION - KLT desires to maintain friendly relationships with its clients (agents, sellers, buyers, etc.). To provide for a mutually beneficial relationship, KLT has established an alternative mediation program in the event of a misunderstanding or dispute between KLT and its clients. If a dispute arises out of or relates to this contract, or breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation. Judgment on the award rendered by the arbitrator(s), or written agreements of the parties, may be entered in any court having jurisdiction thereof or written agreements of the parties. If litigation is necessary to enforce this agreement, the prevailing party(s) shall receive costs and attorney’s fees. If a qualified mediator or arbitrator is unavailable, both parties agree to the submission of the dispute to a mutually acceptable dispute resolution service. The issuance of any tickets, reservations, or bookings by KLT is done on the express condition that:

  1. KLT shall not be responsible for any changes in fares, rates, class of air, seat changes, charges, or prices initiated by the carrier(s) or supplier(s) of services, and
  2. KLT shall not be responsible for any damages resulting from cancellations, lack of approved payments, changes, or disruption of any services and/or for refunds of monies already paid or transmitted to any carrier or supplier of services.

The customer's initial retention of any paper tickets (electronic), reservations, or bookings after issuance shall constitute consent by the customer, on his/her behalf and on behalf of his/her companions, to the above. Nothing agreed to herein by the customer is meant to interfere with the customer’s legal rights against any carrier(s) or supplier(s) of services. The payment of the required deposit or any partial or full payment for a reservation on the chosen tour/package shall constitute consent to all provisions of this Terms & Conditions statement.  These provisions are hereby incorporated by reference in this Disclosure Notice, and clients are advised to take note of them.

KLT is acting as a mere agent for suppliers as stated above and its agents, servants, and employees shall not be responsible for personal injury or property damage, loss or delay, or change of itinerary incurred by any person or tour participant arising out of the act of negligence of any direct or supplemental air carrier or other person or entity engaged in transporting the passenger, hotel or other person rendering any of these services, or accommodations being offered in these tours; nor shall KLT be responsible for any injuries, death, damages, loss, or delay in any means of transportation or by reason of any event beyond the actual control of TATC or of any agent or supplier or due to force majeure.

By signing the KristieLen Travel Portal Terms and Conditions as Primary Traveler, I do hereby expressly agree to forever release, discharge, and hold KLT and its agents, employees, officers, directors, associates,  suppliers, affiliated companies, and subcontractors harmless against any and all liability, actions, injuries, chargebacks, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which I now have or which may hereafter arise out of or in connection with my trip or participation in any activities arranged for me by KLT and its agents, employees, associates, suppliers, affiliated companies, or subcontractors.

The terms of this agreement shall serve as a complete release and express assumption of risk for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me. I have read and fully understand the provisions and the legal consequences of this release and assumption of risk, and I hereby agree to all its conditions.

I acknowledge that KLT recommends that I have my attorney review this release prior to my signing it. I further agree that any legal dispute involving these travel services is subject to the ALTERNATIVE DISPUTE RESOLUTION CLAUSE herein but that in the event that any legal action shall necessitate the use of a court(s) the action shall be heard only by the courts of Collin County, Texas, U.S.A.

I fully understand that this is a legally binding and enforceable contract and sign my name on the KristieLen Travel Portal of my own free will. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

I acknowledge that I have carefully read the above paragraphs as well as the ‘Trip Reservations and Details,’ including the information regarding cancellations and refunds, and by signing the KristieLen Travel Portal, I fully agree to all stated conditions therein. I understand that it is my responsibility to ensure all adult travelers on this trip receive a copy of these Terms and Conditions.
